THE NECESSITY AND LEGAL BASIS FOR THE TRAINING OF LEGAL SPECIALISTS IN THE SPECIALTY 1-24010100 -INTERNATIONAL LAW

Specialty 1-24010100 – International Law was approved by the Decree of the Government of the Republic of Tajikistan No. 349 dated June 30, 2007.

The graduate’s qualification is an international lawyer with knowledge of a foreign language.

The standard period for mastering the basic educational training program for an international lawyer with knowledge of a foreign language in the specialty 1-24010100 – International law in full-time education is 4 years.

The specialty “International Law” was established on March 14, 1994 on the basis of the Law Faculty of the Tajik National University for the training of international lawyers.

Qualification characteristics of the graduate

A graduate qualified as an international lawyer with knowledge of a foreign language should know the essence and content of the legal basis of the state’s foreign policy, the national interest of the state, the main directions and prospects for the development of the science of international law, be able to prepare international treaties, know the procedure for protecting the legitimate interests of domestic citizens and legal entities abroad, conduct research, ensure legal protection of the interests of the Republic of Tajikistan, to promote the peacemaking foreign policy of the Republic of Tajikistan.

A graduate with a degree in 1-24010100 – International Law is prepared to work in various types of government institutions and other non-governmental organizations. The types of professional activity of a specialist are:

– science-production;

– technological;

– organizational and managerial;

– legal expertise;

– teacher (in accordance with the established procedure);

– managerial.

The possibility of continuing the education of an international lawyer graduate with knowledge of a foreign language who has mastered the basic educational program of higher professional education in the specialty 1-24010100 – International Law.

A bachelor’s degree graduate is prepared to pursue a master’s degree.

The basic educational program for the training of an international lawyer with knowledge of a foreign language is developed on the basis of this state educational standard and includes a curriculum, academic discipline programs, training and industrial practice programs.

The requirements for the mandatory minimum content of the basic educational program for training a lawyer in the field of innovation, the conditions for its implementation and the timing of its development are determined by this state educational standard.

The basic educational program for the training of an international lawyer with knowledge of a foreign language consists of the disciplines of the state component, the disciplines of the university component, the disciplines of the student’s choice, as well as optional disciplines. The disciplines and courses of the student’s choice in each block (module) should meaningfully complement the disciplines specified in the state component of the cycle.

The basic educational program for the training of an international lawyer with knowledge of a foreign language should provide for the student’s study of the following blocks of disciplines and the final state certification:

HSD block – humanitarian and social disciplines;

NMD block – natural science and mathematical disciplines;

GPD block – general professional disciplines;

PD block – professional disciplines;

EA block – extracurricular activities;

The content of the national-regional component of the basic educational program for the training of an international lawyer with knowledge of a foreign language should ensure the preparation of graduates in accordance with the qualification characteristics established by this state educational standard.

Terms of mastering the basic educational program of a graduate in the specialty

The term of mastering the basic educational training program for an international lawyer with knowledge of a foreign language in full-time education is 160 weeks, including:

– theoretical training, including students’ research work, workshops, including laboratory 128 weeks;

– examination sessions of 32 weeks;

– practice for at least 10 weeks:

– educational practice for 2 weeks;

– pedagogical practice for at least 8 weeks;

– final state certification, including preparation and defense of the final qualification for at least 6 weeks;

– vacations (including 8 weeks of postgraduate leave) of at least 42 weeks;

The maximum amount of a student’s academic workload is set at 45 hours per week, including all types of classroom and extracurricular (independent) academic work.

The weekly workload of a full-time student should not exceed an average of 30 hours. At the same time, the specified volume does not include mandatory practical exercises in physical education and classes in optional disciplines.

Holidays in the academic year must be at least 7 weeks, including at least two weeks in winter.

Requirements for the development of a basic educational program for the training of a lawyer.

The higher education institution independently develops and submits to the Ministry of Education and Science of the Republic of Tajikistan for approval a curriculum for the training of a lawyer based on this state educational standard.

Elective subjects after the student’s choice are mandatory, and elective subjects provided for in the curriculum of a higher educational institution are not mandatory for the student to study.

Coursework (projects) are considered as a type of academic work in a discipline and are performed within the hours allotted for its study.

The hours allocated to specialization disciplines can be used to deepen subject training.

When implementing the basic educational program, a higher education institution has the right to:

– change the amount of hours allocated for the development of educational material for modules of general professional and special disciplines, within 5%;

– to teach humanities and social sciences in the form of author’s lecture courses and various types of collective and individual practical exercises, assignments and seminars according to programs developed at the university itself and taking into account regional, national, ethnic, professional specifics, as well as the research preferences of teachers providing qualified coverage of the subjects of the disciplines of the cycle;

– to establish the necessary depth of teaching of individual sections of disciplines included in the cycles of humanities and social sciences, natural sciences and mathematics, in accordance with the profile of the cycle of disciplines of subject training;

– to establish the name of specializations in the specialties of higher professional education, the name of the disciplines of specializations, their volume and content, in excess of that established by this state educational standard, as well as the form of control over their development by students;

– to implement the basic educational program for lawyer training in a shorter period of time for students of higher education institutions with secondary vocational education of the relevant profile or higher professional education. The time reduction is based on the existing knowledge, skills and abilities of students acquired at the previous stage of professional education. At the same time, the duration of training should be at least three years. Shorter periods of study are also allowed for persons whose level of education or abilities are sufficient grounds for this.

The implementation of the curriculum for the training of a certified specialist should be provided with educational and methodological documentation for all types of training sessions, each student’s access to library collections and databases corresponding to the full list of disciplines of the basic educational program, the availability of methodological manuals and recommendations for all disciplines and all types of classes, including all laboratory and practical works provided within the framework of academic disciplines.

A higher education institution implementing a curriculum for the training of a certified specialist must have a material and technical base that complies with current sanitary and technical standards and ensures that all types of laboratory, practical, disciplinary and interdisciplinary training and research work of students provided for in the sample curriculum.

The duration of the practice should be at least 14 weeks. During the academic (“passive”) practice, the student observes the work of professionals in practice, acquiring the necessary skills of professional activity. During the period of “active” practice, the student needs to deepen and consolidate the theoretical knowledge gained, learn how to conduct court sessions independently, and learn how to act as a lawyer, prosecutor, or court in the future.

Requirements for the level of graduate training in the specialty

Bachelor’s degree requirements

The graduate must solve the tasks corresponding to his qualifications specified in clause 1.2 of this state educational standard.

The bachelor’s degree must know the official language of the Republic of Tajikistan – Tajik; be fluent in the language in which the teaching is conducted.

The bachelor’s degree must:

– be able to work as a lawyer in government and non-government institutions;

– be able to conduct scientific expertise of regulatory legal acts;

– be able to conduct an expert examination of international legal acts recognized by the Republic of Tajikistan;

– participate in the preparation of scientific reports on assigned tasks and the implementation of research results in the field of international relations;

– to protect the interests of the Republic of Tajikistan within the framework of regional and universal international organizations;

– be able to prepare international treaties of the Republic of Tajikistan;

– to know the legislation of the Republic of Tajikistan in general and in particular, in the field of foreign policy of the Republic of Tajikistan;

– to know the legal basis of cooperation of the Republic of Tajikistan with the countries of the near and far abroad;

– perform contractual work and legal mediation;

– to know the essence of cooperation between the Republic of Tajikistan and international organizations in various fields.

Requirements for the final Bachelor’s degree

The final certification of a future international lawyer with knowledge of a foreign language includes the defense of a final qualification and a state exam in the discipline of International Law.

Final attestations are intended to determine the practical and theoretical readiness of a lawyer to perform professional tasks established by this state educational standard and to continue his education at the magistracy in accordance with clause 1.4. of this standard.

The state examination, which is part of the final certification of the graduate, must fully comply with the basic educational program of higher professional education, which he has mastered during his studies.

Requirements for the Bachelor’s final qualification (thesis) work

The thesis should be submitted in the form of a computer set or a manuscript.

The requirements for the volume, content and structure of the thesis are determined by the higher education institution on the basis of the Regulations on the final certification of graduates of higher education institutions, approved by the Ministry of Education and Science of the Republic of Tajikistan.

The time allotted for the preparation and defense of the final qualification (thesis) is at least four weeks.

Requirements for the state examination of an international lawyer with knowledge of a foreign language.

The procedure and program of the state examination in the specialty 1-240101 – International Law are determined by the university on the basis of methodological recommendations and the corresponding sample program, Regulations on final certification of graduates of higher educational institutions, approved by the Ministry of Education and Science of the Republic of Tajikistan.
