Department of transport law and the right to use natural resources

After the Republic of Tajikistan gained independence, it became necessary to completely rebuild all the legal foundations on which the life of a sovereign state is formed and its citizens live. Much work has already been done to solve this problem. Many laws and regulatory acts related to public administration, economy, agriculture, transport, land use, and observance of the rule of law have been adopted and are being implemented.

The transition to a market economy, the emergence of new economic relations and the diversification of ownership in the Republic of Tajikistan have led to the development of legal relations in society. In this regard, the need arose to study, analyze and research various aspects of environmental law, transport law, agricultural law and land law. From this point of view, the study of the process of general-legal and private-legal regulation of relations between the transport and agricultural sectors in the Republic of Tajikistan, legal issues of the development of environmental legislation, theoretical and legal issues of state regulation of the transport sector in the Republic of Tajikistan, the characteristics of transport relations in the Republic of Tajikistan, environmental protection in accordance with the legislation of the Republic of Tajikistan have acquired scientific and practical significance.

The transport sector is an important sector of the national economy, and its development is one of the priority issues of the policy pursued by the state and the Government of the Republic of Tajikistan during the period of independence. Undoubtedly, special attention to this sector is justified and timely. The historical experience of the developed countries of the world shows that attention to this sector determines the future fate of the development of national statehood. History is a witness that this issue was not without differences in the past, and the political position of the statehood of our ancestors on the Great Silk Road is a testament to this.

The great efforts of the Government of the Republic under the leadership of its Head, the Founder of Peace and National Unity, the Leader of the Nation, the Honorable Emomali Rahmon, are worthy of support in terms of improvement and improvement in this vital area for Tajikistan, which, due to historical and geographical conditions, was in a communication deadlock.

To address these issues, there was a need to train professional lawyers in this area. With this in mind, the Faculty of Law of the Tajik National University, by order of the rector of the Tajik National University dated 22.05.2012, No. 161-09 “On making changes to the structure of the university (on the establishment of a specialized department)”, established a specialized department of transport law and the right to use natural resources within the structural structure of the Faculty of Law. The initiator and founder of the department of transport law and the right to use natural resources was Professor Abdukhalil Davlatalievich Gafurov, Doctor of Law, who served as the head of the department from May 2012 to May 2015. Kurbonov Kurbon Boboevich, Candidate of Law, Associate Professor, served as the head of the department from May 2015 to March 2023. Currently, the head of the department is Sharifzoda Fazliddin Sharif – Candidate of Legal Sciences, Associate Professor (from March 2023 to the present).

Currently, the department is staffed by Professor Odinazoda R.S., PhD, Associate Professor Sharifzoda F.Sh., PhD, senior lecturers Amrenova Sh., Buriev A.R., PhD, assistants Muminzoda O.S., Saidmurodova T.A., assistants Idriszoda Y.A., Yorzoda Z.I., Saidov N.N., and laboratory assistant Salimzoda S.J.

The Department of Transport Law and the Law of Natural Resources Use has so far paid special attention to the development of private-legal and general-legal regulation of relations in the fields of transport, agriculture, ecology, and land.

The department is responsible for teaching the subjects of transport law, environmental law, agricultural law, land law, legal status of subjects of agricultural activity, legal regulation of insurance in the transport sector, the role of the Leader of the Nation in the development of environmental protection legislation, mining law, transport contracts in the full-time department, distance and correspondence forms of second higher education of the Faculty of Law and other faculties of the Tajik National University, for which a curriculum, teaching aids and textbooks have been developed and published.

The Department of Transport Law and the Right to Use Natural Resources has carried out its scientific and research work on the basis of the Scientific and Research Work Plan for 2021 – 2025 under the title “Theoretical and Practical Issues of Public and Private-Legal Regulation of Relations in the Field of Transport, Ecology, Agriculture, Land and the Right to Use Natural Resources” and has achieved certain scientific and educational achievements in this area.

The Department of Transport Law and the Law of Natural Resources Use has so far shown particular interest in the development of private-legal and general-legal regulation of relations in the fields of transport, agriculture, ecology and land. In this regard, the following scientific and research work is carried out at the department:

  • analysis and determination of the legal nature of relations between the transport and agricultural sectors in the Republic of Tajikistan;

– determining the correlation between international environmental legislation and the environmental legislation of the Republic of Tajikistan in regulating private-legal and general-legal relations;

  • establishing the main characteristics of transport relations;
  • determining the position and role of the agro-industrial complex in agricultural law;

–   characteristics of the private-legal and general-legal status of land use relations;

          –   identifying scientific and legal approaches to solving land use problems;

–   determining the legal nature of transport contracts;

–   determining the position of dispositive and imperative principles in the process of defining transport contracts;

–  identifying the main factor ensuring the country’s food security, the source of raw materials for industrial processing enterprises, the sector that forms the country’s export potential, and most importantly, the basis for creating new jobs;

– The department is responsible for teaching the subjects of environmental law, transport law, agricultural law, land law, water law problems, legal regulation of certain categories of land, transport contracts, environmental protection problems, etc. in the full-time, part-time and other faculties of the Tajik National University. A curriculum, teaching aids and textbooks have been developed and published for these subjects.
